When a data theft incident occurs, an important question arises: Is there an obligation to report the data theft incident, to victims and authorities, as a data breach, or can it be exempted (for example, using the “encryption exception”)?   This presentation will provide guidelines for a critical aspect of the forensics investigation, and explain multiple ways that even encrypted data can be compromised.
